Essay

The dissertation is one of the first comprehensive studies on the organizational and legal foundations for ensuring the security of the judiciary. Based on the developed theoretical and methodological principles, and the results of the analysis of the current state of organizational and legal support for the security of the judiciary, practical recommendations for improving the organizational and legal support for the security of the judiciary are presented. For the first time, a unified organizational and legal mechanism for ensuring the security of the judiciary is justified, with the aim of providing comprehensive security for the judiciary to maintain its normal functioning under both standard and crisis conditions, adhering to international standards of judicial system and justice for the continuous and complete administration of justice, judicial protection of human rights, resolution of social conflicts, establishment of the rule of law, and a fair court. In Chapter 1, "Theoretical and Methodological Foundations for Ensuring the Security of the Judiciary," the evolution of the concept of judicial security is revealed, theoretical and normative analysis of the concept of "judicial security" is conducted, and a methodology for ensuring judicial security is developed. It is proven that the concept of judicial security evolves in line with the evolution of scientific views on judicial independence in Ukraine. At the current stage, the issue of judicial security has an interdisciplinary nature and goes beyond the matter of physical security of courts and judges. Based on lexical-semantic and historiographical analysis, as well as an in-depth content analysis of normative and doctrinal sources, new definitions of "judicial security" and "ensuring judicial security" are proposed. It is proven that, given the dilemma of the dogmatism and universality of the law versus the excessive specificity and temporary nature of subordinate acts, the key reference point for justifying the methodology of judicial security is international standards of justice. Based on the research, a two-circuit theoretical model of the mechanism for ensuring judicial security is substantiated. In Chapter 2, "Analysis of the Current State of Organizational and Legal Support for the Security of the Judiciary," a systematic analysis of the legal institution for ensuring judicial security is conducted, modern trends in the field of judicial security are characterized, and a comparative legal analysis of judicial security in the context of a global medical-social threat is carried out using the experiences of Ukraine and Poland. In Chapter 3, "Ways to Improve the Organizational and Legal Support for the Security of the Judiciary," principles for ensuring the security of the judiciary are substantiated, ways to improve the legal status of the Judicial Security Service (JSS) are proposed, and recommendations for the establishment of a unified organizational and legal mechanism for ensuring the security of the judiciary are developed. Based on theoretical and empirical research, a unified organizational and legal mechanism (OLM) for the full development of the judicial security system is substantiated and the structural elements of the mechanism are detailed. To ensure control over the functioning and improvement of the OLM, it is proposed to establish a Permanent Commission of the High Council of Justice on Judicial Security.
