Polishchuk V. Administrative and legal principles of ensuring cyber security in the conditions of martial law and post-war reconstruction of Ukraine

The dissertation is devoted to the scientific analysis of the administrative and legal regulation of cybersecurity in Ukraine in the context of martial law and the prospects for post-war reconstruction. The positive and negative aspects of the current state of administrative and legal support of cybersecurity are defined. The scientific results obtained in the process of research give grounds for conclusions that have both theoretical and practical significance. The conceptual foundations of the formation and development of legal regulation of cybersecurity and privacy on the Internet are considered. The definition of the legal status of cyber attacks and cyber military operations through the prism of international law and ensuring global cybersecurity is studied. The main characteristic features of cyber conflicts that distinguish them from other threats to national security include: spatial boundaries, the possibility of global development in the shortest possible time, the lack of subjective binding to specific actions in cyberspace. It has been determined that the information society has formed an idea of cyber conflict as a way of influencing mass consciousness, by distorting reality regarding the consequences of confrontation between the parties. The result of cyber conflict can be political decisions of global importance that have a significant impact on the process of making major political decisions. The political elite uses the results of confrontation as a plane for legitimizing personal decisions and realizing the goals of the geopolitical level. Various types of cybercrime and their features are investigated. Cybercrime is often difficult to investigate due to a lack of qualified personnel, necessary tools and international cooperation. Cybercriminals often hide behind anonymity, making it difficult to identify and prosecute them. Cybercrime legislation is constantly evolving. Cybercrime is a serious threat to society, so joint efforts of the state, the private sector and citizens are needed to overcome it. The results of the study can be used to develop and improve cybersecurity policies at the public and private level. It is proved that the investigation of cyber attacks as war crimes can help bring the perpetrators to justice, as well as prevent such crimes in the future. A comprehensive analysis of the current state of cybercrime and its impact on national security has been carried out. The focus is on identifying key threats in the digital space and developing strategies to prevent and counter them in order to ensure the security of the state. It is shown that cybercrime is constantly developing, which is associated with the emergence of new IT technologies and an increase in the number of users involved in information processes. The main categories of crimes are identified: illegal download or use of software, fraud and attacks using system vulnerabilities. There is a need to combine the efforts of different actors in cybersecurity with a special emphasis on the role of the state. The scientific work emphasizes that cybersecurity in public administration is achieved by unifying methods of data exchange using transport protocols such as HTTP. The scientific work emphasizes that international information terrorism in the era of information confrontation acquires new significance, in particular, through the use of information structure by terrorists to form network methods and influence information infrastructure objects. An important area of research is the disclosure of the practical experience of information corporations in providing technical solutions to ensure the security of financial transactions and support the global financial system. The study presents the experience of Ukrainian financial institutions that use variable digital protection strategies and maintain their functionality based on an effective cybersecurity system in the context of a global military conflict.
